The WH-347 Statement of Compliance (page 2)
Page 2 of Form WH-347 is the Statement of Compliance. The first page reports the numbers; this page is where a named person certifies them. The form notice says each certified payroll must be accompanied by a signed Statement of Compliance, "e.g., page 2 of the WH-347 or another document with identical wording." This guide follows the Rev. January 2025 edition. It is not legal advice; check the DOL instructions for your situation.
Who signs
The signer is the contractor or its agent who paid or supervised the payment of the workers. The statement opens with "I paid or supervised the payment of the laborers or mechanics working on the above project during the stated time period. I certify the following:". The page header repeats the project name, project or contract number, payroll number, business name, project location and week ending date, and adds the certifying official's name and title.
At the bottom are the signature, date, telephone number and email address. Per the DOL instructions, legally valid electronic signatures are acceptable; photocopied or scanned signatures are not. The form also warns that willful falsification may subject the contractor or subcontractor to civil or criminal prosecution (18 U.S.C. 1001, 31 U.S.C. 3729) and debarment, and that information in certified payrolls may be subject to disclosure under FOIA.
The six numbered items
- Payroll correct and complete; rates not below the wage determination. Wage and fringe benefit rates paid, including credit taken for a bona fide fringe benefit plan, fund or program, are not less than the applicable rates for the classifications actually performed.
- Records complete and available. All regular payrolls and basic records are complete and accurate and available on request from the agency or DOL.
- Classifications are real. The classifications reported are the work each worker actually performed.
- Apprentices registered. Apprentices are registered in a program registered with the Office of Apprenticeship (OA) or a recognized State Apprenticeship Agency (SAA). A table asks for the apprenticeship program name, OA/SAA, and the registered name of the labor classification.
- Fringe benefits. Fringe benefits were paid in cash and/or to bona fide plans, funds or programs. Where an hourly credit is claimed, the "Hourly Credit for Fringe Benefits" table lists, for each worker, the hourly credit under each plan (name, type, plan number, funded or unfunded) and a total hourly credit.
- Full weekly wages paid. All workers were paid the full weekly wages earned, with no rebates or deductions other than permissible deductions as defined in 29 CFR part 3.
Which boxes to check
- Boxes 1, 2, 3 and 6: always checked.
- Box 4: if any apprentices are paid. List each program, OA or SAA, and classification.
- Box 5: if a fringe benefit credit is claimed. If fringe obligations are met entirely in cash, check box 5 but skip the table. If partly through a plan and partly in cash, put plan amounts in the table and cash in column 6C. More than six plans go on an addendum. Unfunded plans require prior DOL approval under 29 CFR 5.28.
Additional Remarks are optional. For the page-1 side of fringe, see the WH-347 fringe benefit columns.
What happened to fringe items 4(a) and 4(b)?
Many people search for "WH-347 4(a)" or "4(b)". Those labels come from older editions of the form, which had a fringe item 4 with (a) for amounts paid to approved plans, funds or programs and (b) for amounts paid in cash. The Rev. January 2025 form has no items labelled 4(a) or 4(b). Item 4 is now about apprentices, and fringe is covered by item 5 plus the hourly-credit table, together with columns 6B and 6C on page 1. If you are working from an old template, compare it with the current DOL PDF. Our guide to the Rev. January 2025 form lists what is on it.
What the WH-347 Layout Tool does on page 2
The WH-347 Layout Tool fills the page-2 project header, the certifying official's name and title, the checkboxes you tick, and your remarks. It deliberately leaves the signature, date, telephone and email blank so the person certifying can review and sign. It does not fill the apprenticeship-program table or the hourly-credit-for-fringe table, and it does not decide which boxes apply to you. You tick them.
Frequently asked questions
Who signs the Statement of Compliance?
The contractor or its agent who paid or supervised the payment of the workers, with their phone number, email address and the date.
Which boxes on page 2 must always be checked?
Per the DOL instructions, boxes 1, 2, 3 and 6 must always be checked. Box 4 is checked if any apprentices are paid, and box 5 if a fringe benefit credit is claimed.

The DOL instructions say legally valid electronic signatures are acceptable, but photocopied or scanned signatures are not.
